Data protection

The protection of the data we process is important to us! We follow all applicable legal requirements in all data processing operations (e.g. collection, processing, and transmission). In addition to the Swiss Federal Act on Data Protection (FADP), this also includes the provisions of the European General Data Protection Regulation (GDPR) – even though it is an EU regulation. The GDPR applies, among other situations, when personal data is processed in connection with the offering of goods and services to data subjects located within the EU.

 

The following statement gives you an overview of what types of data are collected by Daily HR GmbH (hereinafter "Daily HR"), how this data is used and shared, what security measures we take to protect your data, and how you can obtain information about the data provided to us.

2. Encryption

For security reasons and to protect the transmission of data you send to us as the website operator, our website uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address bar of your browser begins with "https://" and displays a padlock icon.

When encryption is enabled, any data you transmit to us cannot be read by third parties.

 

3. Data Collection, Processing, and Purpose of Processing

a) Personal Data

"Personal data" (hereinafter also "data") means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

 

b) Automatically Collected Data

When you visit our website at www.dailyhr.net, www.dailyhr.ch, or www.dailyhrcoaching.com, the web server automatically records so-called log files on the basis of our predominantly private interest or our legitimate interests pursuant to the FADP or GDPR.

 

This data includes:

 

- Browser type and version

- Operating system used

- Referrer URL (the previously visited page)

- IP address of the requesting computer

- Date and time of the server request

- The file request of the client (file name and URL)

 

This data is collected solely for the purpose of statistical analysis and for security reasons (e.g. to investigate misuse or fraudulent activity) and is stored for a period of 7 days, after which it is deleted. Should longer retention of data be required for evidentiary purposes, it is exempt from deletion until the matter in question has been finally resolved.

 

c) Registration / Sign-Up

You can generally visit the Daily HR websites without providing any personal data.

However, if you register or sign up to use our services, we collect, process, and use the personal data you provide in accordance with the FADP or GDPR for the purpose of fulfilling our contractual obligations and service commitments.

To carry out and process the service, we require and process the following data:

 

- Your full name and/or full company name, along with the names of authorised representatives or contact persons

- Your email address

- Your postal address

- Billing address and, if applicable, a separate delivery address

- Your telephone number

 

If you register as a candidate or interim manager, we additionally store the following data, provided you supply it:

 

- CV data such as photo, gender, date of birth, marital status

- Education and training data

- Previous places of employment

- Information on your professional role and activities

- Career preferences

 

You have the right at any time to access, correct, and delete your registration data.

 

d) Use of a Contact Form

When you use our contact form, we collect your email address, your name, and any data or information you provide, on the basis of the FADP or GDPR, for the purpose of fulfilling pre-contractual or contractual obligations or carrying out related measures. The personal data you provide as part of this contact request will only be used to respond to your enquiry and for the associated technical administration.

 

Contact by Email

You may also contact us directly at info@dailyhr.ch. In this case, we store your email address and message on the basis of our legitimate interests pursuant to the FADP or GDPR, or for the fulfilment of pre-contractual or contractual obligations or the implementation of related measures in accordance with the FADP or GDPR. The personal data you provide in the course of this contact will only be used to respond to your enquiry and for the associated technical administration.

 

4. Disclosure of Personal Data to Third Parties and Processors; Hosting

a) Your personal data is disclosed primarily in accordance with the FADP or GDPR, i.e. where necessary for the processing and fulfilment of contractual obligations. Beyond this, we only share data on the basis of your express consent, where a legal obligation requires it, or on the basis of our legitimate interests. This concerns in particular the following categories of recipients:

 

- Transmission of a candidate's name and address to a client

- Service providers and processors (e.g. payment service providers or IT providers)

- Accountants, auditors, lawyers, and other external advisors

- Legal and regulatory authorities, upon request or for the purpose of reporting an actual or suspected breach of applicable laws or regulations

- Domestic and foreign authorities, courts, or other parties in potential or ongoing legal or debt collection proceedings

- Any relevant party for the purpose of preventing, investigating, detecting, or prosecuting criminal offences or enforcing criminal sanctions, including safeguarding against threats to public security

 

b) Before we forward a candidate's data to a client, the candidate is always asked in advance by email – with the specific job description and company name attached – for their consent. The scope of data transmission is generally limited to the minimum necessary. Our contractual partners may use the data transmitted in this way exclusively for the purpose of fulfilling the assignment.

 

c) Our website is hosted by the service provider WIX.com Luxembourg S.a.r.l., 5 Rue Guillaume Kroll, L-1882, Luxembourg.

The hosting services serve to provide infrastructure and platform services, computing capacity, storage space, database services, security services, and technical maintenance. We, or our hosting provider, process inventory data, contact data, content data, contract data, usage data, and meta and communication data of customers, prospects, and visitors to this online service on the basis of our legitimate interests in the efficient and secure provision of this online service in accordance with the FADP or GDPR. Data is processed on the basis of a data processing agreement pursuant to the FADP or GDPR.

d) Where we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or where this occurs in the context of using third-party services or disclosing or transferring data to third parties, this only takes place where necessary for the fulfilment of our pre-contractual or contractual obligations, on the basis of your consent, due to a legal obligation, or on the basis of our legitimate interests. Processing is carried out, for example, on the basis of specific guarantees, such as the officially recognised determination of a level of data protection equivalent to that of Switzerland or the EU (or compliance with officially recognised specific contractual obligations, so-called "standard contractual clauses").

 

5. Cookies

In order to make the use of the websites more user-friendly and effective overall, Daily HR itself, or third parties commissioned by us, stores so-called cookies on the customer's hard drive.

A cookie is a small text file used, among other things, to collect information about how a website is used. Cookies cannot execute programmes or transmit viruses to your computer. They do not contain personal data, cannot be attributed to specific individuals, and, unless otherwise stated, are automatically deleted after no more than two years. This data is not merged with other data sources.

Under applicable data protection law, we may use cookies where they are necessary for the operation of the website ("strictly necessary cookies"). For all other cookies, we require your consent, which is obtained via our cookie banner. Through the cookie banner, you can either accept all cookies, reject all cookies (with the exception of strictly necessary cookies), or make a specific selection.

In addition, you can disable the storage of cookies entirely in your browser settings, restrict them to certain websites, or set your browser to notify you whenever a cookie is sent. You can also delete cookies from your computer's hard drive at any time. If you block cookies entirely (including strictly necessary cookies), this may affect your use of our website and certain functions (such as language selection) may no longer work.

 

6. Use of Social Plug-ins

We use so-called social plug-ins ("plug-ins") on the basis of our predominant or legitimate interests within the meaning of the FADP or GDPR.

 

a) XING

Our website incorporates the XING Share Button, a plug-in of the social network XING. The service is provided by XING SE, Dammtorstraße 30, 20354 Hamburg, Germany.

When you access this website, a brief connection is established via your browser to the servers of XING SE ("XING") to enable the "XING Share Button" functions (in particular the calculation/display of the counter value). XING does not store any personal data about you from your visit to this website. In particular, XING does not store IP addresses. No analysis of your usage behaviour through the use of cookies in connection with the "XING Share Button" takes place.

b) LinkedIn

Our pages incorporate plug-ins of the social network LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. You can recognise the LinkedIn plug-ins by the LinkedIn logo on our page.

When you visit our pages, the plug-in establishes a direct connection between your browser and the LinkedIn server. LinkedIn thereby receives the information that you have visited our page with your IP address.

We wish to point out that, as the provider of these pages, we have no knowledge of the content of the data transmitted or its use by LinkedIn.

7. Your Rights

Regarding your rights and further questions on the subject of personal data, you may contact us at any time using the contact details provided under item 1 above.

You have the following rights:

 

a) Right of Access and Right to Data Portability

You have the right at any time to request information about the personal data we hold about you, its origin and recipients, the purpose of processing, the planned duration of data storage, the identity and contact details of the controller, and furthermore a copy of the personal data that is the subject of processing.

 

b) Right to Rectification

You also have the right at any time to request, within the limits of the law, the correction of inaccurate personal data or the completion of incomplete personal data.

 

c) Right to Withdraw Consent

You have the right to withdraw your consent to data processing at any time and with effect for the future, without the need to provide any reason for doing so.

 

d) Right to Erasure

You have the right to request the erasure of your personal data where it is no longer necessary for the purposes for which it was collected or otherwise processed, or where you have withdrawn your consent to lawful processing and no other legal basis for retention exists. Your data will also be erased if you object to the processing and there are no overriding legitimate grounds for processing. Finally, data will be erased if processing is unlawful for other legal reasons.

 

e) Right to Restriction of Processing

You have the right to request restriction of the processing of your personal data where you contest the accuracy of your personal data, for a period enabling us to verify the accuracy. Restriction also applies where the processing is unlawful but you oppose erasure and request restriction of use instead; where we no longer need your personal data for the purposes of processing but you require it for the establishment, exercise, or defence of legal claims; or where you have objected to processing but it has not yet been determined whether Daily HR's legitimate grounds for retention override your interests.

 

f) Right to Data Portability

You have the right to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format, or to have it transmitted to another controller, provided that the processing is based on consent and is carried out by automated means.

 

g) Right to Object

You have the right to object at any time to profiling or the creation of user profiles and to the processing of your personal data. Your personal data will no longer be processed unless there are compelling legitimate grounds that override your interests, rights, and freedoms. Where your personal data is processed for the purpose of direct marketing, you have the right to object to such processing at any time.

 

h) Right to Lodge a Complaint

You also have the right to lodge a complaint with a supervisory authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner: http://www.edoeb.admin.ch. 8. Retention Period

We delete your personal data as soon as it is no longer required for the fulfilment of our contractual and legal obligations or for the other purposes for which it was processed. It is possible that personal data may be retained for the period during which claims can be asserted against us, or to the extent that we are otherwise legally obliged to do so (e.g. for commercial or tax law reasons), or where legitimate business interests so require (e.g. for evidentiary and documentation purposes). Once your personal data is no longer required for the purposes stated above, it will as a general rule, and to the extent possible, be deleted or anonymised and its processing restricted. Shorter retention periods generally apply to operational data (e.g. system logs).

 

9. Amendments to this Privacy Policy

We may adapt or update this privacy policy at any time without prior notice. The version currently published on our website shall apply. To the extent that the privacy policy forms part of an agreement with you, we will notify you of any changes by email or by other appropriate means in the event of an update.
